Condominium Owners Nova Scotia (CONS) was formed as a result of a growing discontent among condo owners about the quality of construction that went into their buildings.

Specifically, CONS was concerned about the inspection process for new construction, the length of the warranty period for new construction, and the lack of consumer protection for buyers of new condominiums.  In addition, the Condominium Act needed revision to more effectively settle disputes between Condo Boards and owners.

 

As a result of CONS effort, the previous Government listened to our concerns and engaged Novus Consulting to review protections that were currently in place for owners of new homes/condominiums and to make recommendations for improvement.  In September of 2008, Novus Consulting submitted its final Report on Home Owner Protection.  There were eight recommendations that were supported by CONS.  If implemented they would address the concerns CONS had with the construction process of new condominiums.

 

A second issue that of concern to CONS was the need to update the Condominium Act to reflect the new reality faced by Condo Boards and owners.  Again, we were pleased that the Government again listened to our concern and appointed a Committee to review the Condominium Act.  CONS was a member of that committee and is pleased, that once more, our concerns with Act were adequately addressed by the review Committee and accepted by Government.  The new Act was proclaimed into law as of September 1, 2011.
